1. Acceptance of terms

By using Racing Australia's (RA) myhorseracing.horse portal, you accept and agree to be bound by these Terms of Use which constitute an agreement between you and RA.

2. Limitation of liability

To the maximum extent permitted by law, RA will be under no liability in respect of any loss or damage (including consequential loss or damage), whether or not RA was aware of the possibility of such loss or damage, which may be suffered or incurred or which may arise directly or indirectly in respect of:

  1. Any services supplied or provided through myhorseracing.horse;
  2. Any delay, omission, default or error of RA, its employees or agents, whether negligent or not, in relation to:
    1. the lodgement of applications or notifications (or any other transactions);
    2. the publication of any information;
  3. Any error or delay in the processing of transactions; or
  4. Any technical malfunction or other problems with any telephone network or service, computer systems, servers or providers, computer or telephone equipment or software.

To the extent that RA's liability cannot by law be disclaimed, RA's liability for any loss or damage suffered or incurred in relation to the use of myhorseracing.horse is limited to, at RA's option, supply of the services again, or the refund of the relevant fee paid, if any.

3. Australian Rules of Racing

By lodging an application or notification (or engaging in any other transaction) through myhorseracing.horse you accept and agree to be bound by the Australian Rules of Racing and the Local Rules, Regulations, By-Laws, Policies and Conditions of the Principal Racing Authority (PRA) and the Racing Integrity Body (RIB) (if applicable) for the State or Territory in which your horse/s is domiciled, trained or raced.

4. Recording of calls and logging of online activity

  1. All online activity through myhorseracing.horse is logged.
  2. The recorded online activity reports may be shared with the PRA and/or RIB in each State and Territory of Australia in order to:
    1. enable PRAs and RIBs to fulfill their functions and responsibilities;
    2. promote and protect the integrity of racing; and
    3. ensure compliance with the Rules of Racing.
  3. The recorded online activity reports may also be disclosed to third parties such as government enforcement agencies, appeal bodies, race clubs or other authorities as required, but only for one or more of the purposes described above.

5. Security

  1. It is your responsibility to keep your user ID and password secure at all times and not share them.
  2. RA reserves the right to monitor the use of its systems by your user ID.
  3. Where breaches of security and the integrity of RA's systems are identified, they will be treated with utmost seriousness and you may be subject to penalty under the Rules of Racing, civil action or criminal prosecution.

6. No partnership

Although RA provides some of the information on myhorseracing.horse in conjunction with other parties, RA and those other parties are independent organisations. Nothing on myhorseracing.horse should be deemed or construed as creating a joint venture, partnership or agency relationship between RA and any other party.

7. Variation of terms

You agree that RA may change these Terms of Use from time to time without prior notice. We will post the updated terms on myhorseracing.horse and they will take effect immediately unless otherwise stated. Your ongoing use of myhorseracing.horse after the changes take effect constitutes your agreement to be bound by and comply with the updated terms. You are responsible for checking the Terms of Use regularly for changes.
